First and second offenses within 10 years are misdemeanors. For a DUI first offense, a minimum of five days jail time must be served; for a DUI second offense with 10 years, one month jail time is the minimum. Virginia DUI third offenses, and subsequent DUI offenses within 10 years, are felonies.
